Is anyone here living and working (freelancing) in the USA, but not a US citizen?
I have recently been invited to move to the USA and work under the title of freelance until the company are able to get a proper work permit for me (they have used all of their permits up until next year).
Just wondering if anyone here has experienced this, and if there is a limit to how much freelance + living in the US work you can do before you get kicked out?
I am paranoid that the real visa thing may take a while to work out, and I might be asked to leave the country after a certain amount of time......?
(+ I am an aussie)Oh, I'm also wondering what kind of paperwork is reqired to enter the USA under these circumstances....?

You should ask the company willing to sponsor you. As far as I am aware you CANNOT work without a visa...so I don;t see how you would work freelance while the company sorts out your working visa.
It took me f-ing months to get mine, and my wife is american!

Yeah, I'm not really sure what they were thinking- I think they were gonna pay me into my canadian bank account or something to begin with. Gosh this could be sketchy.....

how big is the company?
if it's one of those global agencies, i would assume it should be fine.
if the company is asking you work without visa, then that's a bad sign. you can't not work without work permit. unless you are acting as an international consultant, i think...

Hi, I would be careful, there is no way to be offically freelance I don't think. You could work unofficially for however many months you are allowed to stay on a tourist visa. Also there is a way if you have a company to set up a contract with the US company and you get sent out on behalf of your comp, if that makes sense. Not sure but it was one of the possibilities I look at. Be careful though, the US immigration is not one to fuck with!

I'm french, and I'm working as a freelancer, have my own company in France. I'm in the US with a tourist visa(3months). I've worked with a lot of NY based companies. They paid me via direct transfer on my french Bank account. Some companies require a ITIN (Identification Tax Number), I only had to fill a W7 form, bring it to IRS and with a letter from an employer that is interested working with me, I began the application process. So, no problems.

sp to do this from the UK you would need a ltd company or can you do it as a sole trader?

Cool, so Ideal, 3months is the maximum amount of time you would be allowed to stay in the US with a tourist visa? Then I guess you would have to leave, but could you come back? Are you also applying for a perminent work visa? >.
