i made a website for a small local business and used a music clip (pop song) in the flash intro on the homepage.
am i putting myself or the client at risk of getting sued for using the music without buying a $100,000 (or whatever) license from the artist.
is it safe to assume that if anyone has a problem, they will just politely ask the client to remove it? (which they will immediately do)

That's a bit of a grey area, I don't think there is any telling what the copyright holder will do when they find it.
As a good citizen I would say don't bother risking it at all.
But then again, depending on the chances of them actually finding it, I would tend to say that you should just go for it.

depends on the length of the clip and the record label if the artist doesnt hold the rights.
a couple of years back, it was safe to use 20 seconds of anything from sony. last year, i wrote a mail to Virgin about the same thing but they didnt raply.
anycase, for the last few years, i mix my own since most clients understand the value addition.

Don't use it.

I wouldn't use it. A local strip club had a site made and the designer placed a vector drawing of a girl he got on a site. Turns out, the vector drawing was based on a photo of Catherine Zeta-Jones, which the artist did not disclose. Her lawyers called the club and they removed it immediately, but last i heard, she was still going to sue.

What sample are you using?
- ethios0
mayo, that's fucked up. If it's a vector, it doesn't matter as it's derived from the original, not copied.
Like she needs the fucking money anyway...geez
- mayo0
yeah, this article doesn't say it was "vector" but i remember seeing the image they used in another article when this first happened. It looked like a really well-done 3d rendering.

It all depends..
is this for a small company site?

If its the first one, I doubt they will find it..
