ok, i realize this isn't the proper place to ask this question but maybe someone know the answer.
if your lease is running out and you send you land loed a letter say you do NOT want to sign on for any more then six months and is there a way to work out another arangment, then they call you and over the phone say "don't worry about it you can just be on a month to month basis, just give me a one month notice when you decide to leave."
then when it comes time to leave the land lord claims the the first letter you sent is a letter of intent and that it is a legally binding six month lease.
this is bull shit right? what does the law say? keeping in mind i am in the US in pennsylvainia.

No way. In no way is a letter you send a legally binding LEASE. That's ridiculous. I would check this guys background and see if he's even leasing it to you legally.

No lease, no problem. They have no leg to stand on. Of course, they could take you to court but I don't think they could win.

You don't need to call a lawyer/attorney or whatever. Obviously your land lord is cool with you staying as long as you want without signing a new lease. A months notice is polite. Sounds like they were just responding to your letter about not wanting to sign up for a new lease.

just make sure you have copies of the correspondence between you and the land lord. that should be more than enough to dispute their claims

my friend has been living in the apartment under this "month to month" verbal agreement for three months now and wants to leave, so she gave her on months notice and he is claiming she own him for another three months on this "letter of intent" bullshit.

Leases here (Halifax NS) usually atomatically renew themselves unless you terminate it within 3 months of the aniverasary (a letter from them stating you wish to go month to month on your lease aniverary will also do. You are legally responsible without re-signing (the termination clase is usually in your origional lease). The letter to sign up for 6 months probably stands... its not going to matter what they said if they won't own up to it. Tell them you just can't pay and offer them a token payment (half month or something) to break it if you need. Good luck.

with her letter she has an ace in hand. it clearly says she will be paying on a month by month basis.
if it's going to be a pain in the ass she may just have to ride it out for 3 more months.
if that's the case tell her to throw some major ninja parties and don't forget to invite me. i'll bring the hobos.

I worked for a landlord... It costs more money for them to take you to court than most leases are worth. When I leave an appartment, I give em about two weeks heads up. Even if I have a lease.
Nobody ever does anything. Although I've never owed back rent and I always pay on time.
If you wanna leave, just leave, They won't do shit.

haha ricstultz, i bet your right, it will coast thim more then the lousy $2100 rent to even talk to a lawyer. good to know.
