who is your insurance company?
hopefully it's someone somewhat big... or bigger than hers.
if it comes down to it call them.
you may have to get a lawyer involved and take it from there.
back in college i was pulling into a faculty only parking lot because i had to unload a large student project and didn't feel like walking from the student lot, a lot of people did it, so i'm pulling into the lot and there is a parking spot on the right hand side, so i naturally pull to the left to make the turn in, some idiot backs right into me... another student no less. the cops come and cause she happened to be a hot chick i get these cops saying it was my fault, i must have been going fast, and 'what were you doing parking in here to begin with'... i was like 'she's a student too so what was SHE doing in here?' and 'i saw her just before she hit me and she wasn't even looking where she was going'. in the end our ins companies battled it out cause of course the bitch tried saying i shouldn't have been there and guess what... she lost. she hit me. so... you may have to suck it up and call them.

my insurance is progressive kona.
another thing that i might be fucked on is that i live in minnesota which is a no-fault state. GRRRRRRRRRRRR

ah sweet. i had them for about 5 years. they'll kick the hell out of her company. i had them wehn i got in my accident and they went after them with their sleeves rolled up. think of it this way, if they do try and jack up your rates tehre is a ton of other providers out there.

if you don't want to contact your insurance company, i'd say you should hire a lawyer. let the other insurance company know you are doing so...if you win (which you should) they'll have to pay for your lawyer. that's something they always try to avoid.
did you file a police report? no matter what the situation, that is step one. it protects you in this type of situation, and the insurance companies have more difficulty playing the he said-she said game.

yeah, i may have to do that sputnik. thanks for the advice. oh, and there was no police report filed. the accident was so fast and in a parking lot so niether of us even thought about calling the police. crap!
