nah you don't understand man...I can't have a criminal charge on my record or the INS can make life very difficult for me getting citizenship and leaving/entering the country....
IF there had been signs and IF we had to jump fences and sneak about - then I would swallow my pride and accept I was in the wrong. BUT there were neither of those things so by law, apparently, I cannot get charged for trespassing.
Thats why I am fighting this.

true that. I am gonna have to be careful as heck from now on. In ENgland this wouldn't even be an issue - we'd get told to piss off and that would be that...why do fucking cops here have to be such cunts? Why is everything a potential liability!!

I agree that it is lame that there weren't any signs or anything. The least the caretaker guy could've done was give you guys a warning first or something. Instead of immediately calling the cops.

They can't charge you with trespassing if there isn't a sign, Jevad. Even if there IS a sign but its blocked you're not responsible for their blunder.

I wouldn't lay down to them either man, just ask for leniency from the magistrate. Don't go in there and start talking about failure to post proper signage, they'll be reactionary.

thats a good point mimio. I'll have to see what the lawyer says though - I believe he is going to work on getting the charges dropped before it even gets to court.
This whole ordeal makes me incredulous about the US legal system....surely taxpayers money would be better spent catching real criminals?

If you were to break your neck while skating that very pool, you could sue the shit out of the owner and make a very good case which would likely destroy whatever life's work has gone into amassing his nest egg. That's how it works in our liability-bogged judicial system, and no, it is not always fair. Not to you. Not to the guy who lost his hotel to a skateboarder with a broken neck.

I know it sucks, but I'm sure you now understand that people have no patience for skateboarding in this country. A few years back, there weren't even skate parks, bro. Imagine that shit. Plus, there's no way the cops could've known before responding to the call that you are like, 42! =) They should've given you a warning, but that doesn't stop punk ass skaters and they know that.
