Non-compeate contract

I have a non-compete contract from one of my previous employers. and I just moved back into the area where i am affected by it so i went down to their office to get a copy of the contract.
to my surprise, they never signed my non-compete it just has my sig a witness and a spot for the Owner/president to sign but with no signature, so would this make my contract VOID?
or is this just wishful thinking

Well, I suppose it would depend on the situation and your location. Non-Compete's are very difficult to uphold in the State of California. You could say you were waiting for a fully endorsed copy of the Non-Compete and never received it therefore you feel that it is null and void. However, if you were to steal their largest client and they sue you and you end up in front of a jury "of your peers" you may end up getting screwed. I think as long as you stay away from their client list you have nothing to worry about.

Get a lawyer for this.
But from what my girlfriend says (who happens to be a lawyer) generally, is that it's not the specifics of if it's signed or not, but really the fact that both parties have engaged in that agreement..which it can be argued that it has.

Yup - you signed it. Dumb move. Never sign anything without your lawyer.

They won't enforce the non-compete portion of your contract after 6 months.
