Well, I suppose it would depend on the situation and your location. Non-Compete's are very difficult to uphold in the State of California. You could say you were waiting for a fully endorsed copy of the Non-Compete and never received it therefore you feel that it is null and void. However, if you were to steal their largest client and they sue you and you end up in front of a jury "of your peers" you may end up getting screwed. I think as long as you stay away from their client list you have nothing to worry about.
