Hey guys,
I am not sure if this is the right forum to be asking, because I am sure most of you a web designers etc... And this rule probably doesn’t apply because a website is seen around the world.
I need some advice on intellectual property
I the next coming months I will be working on developing a campaign for an Australian fashion label. (Can’t say) The client has just got distribution rights for USA,mexico, and Canada which means my campaign that I come up with will be taken overseas and put in a shit load of magazines , websites, shops etc.
I have done a previous campaign before for these guys but it was only circulated in Australia. By campaign I mean coming up with whole concepts for photo shoots, designing all media involved etc
my question when quoting for a job that you know that the client will be using in the whole of the US do you charge more because its going out to a larger audience etc.. and how do you work it out?

Go for an extra-payment, if not, try to convince the client to let you spread the credits on that campaign (you/your site), but it depends a lot on freelancers methods to work with clients.
Will you work by written contract or is it simple agrrement?
If you work with the contract, make sure to add a line with this issue requiring for an extra or something...(not sure if I understanded clearly your question)

Nope, we don't charge extra for that, unless it means changing anything in the campaign, of course.
Audiences are a lot different around the world and what works in some areas might not be apropriate at the neighbours. So there have been times where we've made different versions of the same campaign so it evens out anyhow with the extra cost.

Not only do you have rights to more money based on a larger audience, you also have the possible right to any royalties based on sales from these campaigns.
Because you already know that these campaigns are going be distributed in other countries & possibly in different languages, you have the ability to charge more, not only for the concept, but also based on the different audiences. You now have to consider a multiracial/cultural audience and figure out what type of consistent look & feel is going to work for the company. You are going to have to do a boatload of extra research to accommodate these new audiences & consider developing an international campaign (which is huge) instead of a campaign that is meant for local distribution, then changed up a bit to go to a new audience. If that were the only thing to change, then they are wasting their efforts since techniques & audience can change from zip code to zip code. You can imagine the difference from 1 country to the next.
Not to mention the intellectual property for everything. A campaign isn't just an ad & flyer. You are being asked to figure out & capture the perfect audience for the company. These findings & development from the findings are yours. You own them & are only giving them permission to use them for a period of time. You can offer ownership of the ideas you create, but then you get into even more money.
Again, you are charging them royalties for your efforts. Their are books you can find that talk about this type of stuff. You have to figure out what the law permits you to do and how much ownership of the materials you have. These things will also be disclosed & accounted for in your contracts & agreements.
I hope this helps a bit. I have been reading a book about this type of stuff.

thanks fro your opinion...still got to work out how I approach the cleint in to askin for more cash....I need a good solid source that I can justify it.
