if it borders, i'd do nothing.
if it was using images proprietary images/ content illegally, then i'd call a few fellas of the Seabassian persuasion to send the message home.

hypothetically, it'd be more of a layout issue. if it were images i'd be hypothetically angry, rather than just hypothetically annoyed.
the do nothing way seems like the way to go (if this ever actually happend to me, ofcourse). I wouldnt want to come off as being vindictive and petty... hypothetically.

The thing to remember is, legally layout, concept, etc...can't be stolen because it can't be owned.
Think about it logically and historically, the invention and usage of the Grid in design. If a person was able to own a layout techique then none of us could legally use the Grid. How would that effect design?
This is why everyone needs to read international copyright law. There are forms of design and creativity that CAN NOT be owned or copyrighted.
Things like concepts, ideas, calendar data, etc...
It's all in the law, in black and white.
Now, if you look at the source and discover it is your exact code...ie. comments, references, etc., that match yours then you could probably say something. I would.

i would look it at more as an ethical issue than a legal one.
no desire for legal recourse, just "hey, what the shit" sort of a thing... hypothetically.
at least they hypothetically linked back to me.
i think when you first see this sort of thing, you over react at first, which ive done before, and which is why i also follow the 'do nothing' school of thought... once again hypothetically.

i usually kick anyones ass who's site even uses the same colors as i do. sometimes even the same words,... like 'the' and 'ending' and 'click here' and stuff.
i mean... can't those fuckers make up their own words and colors? man..... it just pisses me off.
