One of the hottest most controversial court case ever about censorship and sexual harassment.
---------------------------Should art directed at specific people depicting sexual orientations be considered sexual harassment, or simply an artist excercising his/her freedom of expression?

Both. As well as really unethical and abusive to ruin people's reputations...including the poor 82 year old woman.
This story is worse and more depressing then the CNN Peace news somebody broadcasted here :-(

I didn't read the rest of the brief (cos it's not brief, damn lawyers) but it seems to me that what happened to Mary Herberg should not automatically fall within 1st amendment protections. she's no public figure, and the piece was rather close to slander/libel without it being technically so. maybe I'll finish it and figure it all out...
But that's why I hate art. in the end, it's just expression. people have this idea that art makes expression more virtuous or precious, which is bs. art should not be about shock value or getting a reaction. It should be about saying something, which is why shock art says nothing to me.
And no, I'm not a fan of feces and vanginas strewn around a madonna. although the dissected and sectioned cow was somewhat interesting, just somewhat...

and yep, from what I read the reason it was dismissed was because she sued for hostile work environment and sexual harassment, and the courts found it wasn't. the 1st amend has nothing to do with the case.

what matters is the intent of the work. if the work's sole intent is to draw a reaction, it's worthless. I doubt it's so for picasso.

I think Mary Herberg shouldn't even be working at an art school, she should just go back home, find a nice pillow to lay on, and chill.

its easy to "shock" an audience but its not easy to "shock and teach" an audience.

Most people don't have to deal with the abuse she has to...and her job was a low level admin one, from what I gather from the article...
A lot of seniors have to work since social security doesn't pay all their bills.

I understand that from time to time, students at CalArts may create works of art which can depict me in unfavorable lights, including but not limited to, a) a sexually provative manner, b) the act of sexual union, c) leud acts involving my genetaila, d) performing obscene acts with a dissected and sectioned corpse of a cow. I realize that these students are probably spoiled rotten by parents who donate generously to CalArts, and it's best not to mess with these kinds of people (hereforward referred to as "rich snotty pieces of shit").
