I didn't read the rest of the brief (cos it's not brief, damn lawyers) but it seems to me that what happened to Mary Herberg should not automatically fall within 1st amendment protections. she's no public figure, and the piece was rather close to slander/libel without it being technically so. maybe I'll finish it and figure it all out...
But that's why I hate art. in the end, it's just expression. people have this idea that art makes expression more virtuous or precious, which is bs. art should not be about shock value or getting a reaction. It should be about saying something, which is why shock art says nothing to me.
And no, I'm not a fan of feces and vanginas strewn around a madonna. although the dissected and sectioned cow was somewhat interesting, just somewhat...
