I think by definition, design is more of an answer or solution to a problem. Where art is an expression or representation of something (tangable or intangable). When your designing something your creating something that serves a predetermined purpose. in the case of a menu, your designing something that addresses the need for an organized list of product, and prices. The designers job in this case is to present something that is functional before it's stylish, although a good designer will strike a balance between the two. Is creating a menu considered artwork? Well i suppose you can call anything art if you want to, but I will call it a menu - which is more a device than anything else.

A movie poster is also a device that is designed to comunicate the title, cast, mood and opening date of a film. There is artwork on the poster, but the poster itself is a design or device which serves a purpose.

Your right, these are just words, designer and artist art and design. But there does seem to be a distinction between the two.
