  is there a preloader on it?
  if not, and you take it into the bandwidth profiler, yeah, you're gonna have a damn slugish movie just cause it's not gonna be loaded , but it'll still try to play it

  and no, there's no way to tell an swf from a legal app or an illegal one. the swf format is an open format, it just so happens that macromedia makes the most popular program to make 'em with... they can't screw with the format without telling us
