Is there no legal recourse to remove a county clerk if they fail to perform their job? She's clearly unwilling to issue licenses so why not just start the process of her removal? Jail for someone who's unwilling to perform a service due to religious convictions seems completely unethical and tactless.
- Seems so simple right?monospaced
- lol, lets jail some one for their religious beliefs. now we are talking. burn baby!yurimon
- not so easy i see.. well, I guess she's our newest cult hero

- lol @ honest dick tate. so whos the fascist in all this?yurimon
- She's a public employee, and should serve the tax payers who pay her salary (including gay people).yuekit
- meh, jail was a bit much. marriage as a civil institution is pretty silly anyhow********
- But realistically that's not going to change anytime soon.yuekit
- Silly as it may be, everyone should have the right to it.iCanHazQBN
- it isn't a right you dumb fuck. do you understand what rights are********
- I don't think you do.iCanHazQBN
- Oh then enlighten me. Show me what grants you the right to marry********
- The fact that you and your wife can get married and file a document in a government office and receive the benefits that come along with being married...iCanHazQBN
- is what you are being granted. And it is also what is NOT being granted to gay couples (not until recently).iCanHazQBN
- Personally, I believe because she works for the govt who sanctioned gay marriage she should resign her post. However,Hayoth
- She should not have been jailed. That's psychotic dictatorship territoryHayoth
- so in stead of examining why a religious institution has been co-opted by civil law, you want to bitch about how unfair it is that the religious types have trac********
- traction on this intrinsically religious matter and in stead of arguing law, throw around the word 'rights' without any concept of what the word means********
- why do have a license for marriage? states have rejected marriages, rarely these days however. you cant argue it as right. only in the common law.yurimon
- fucking idiots********
- this is what you doing in an application people.yurimon
- petition, A written address, embodying an application or prayer from the person or persons preferring it, to the power, body, or person to whom it is presented, yurimon
- for the exercise of his or their authority in the redress of some wrong, or the grant of some favor, privilege, or license. In practice. An application made toyurimon
- a court ex parte, or where there are no parties..yurimon
- Make all the abstract arguments you want, realistically government is not going to get out of marriage entirely anytime soon.yuekit
- So in the meantime, are you going to defend the right of some low level bureaucrat to selectively enforce the law?yuekit
- Funny how it's only once gay marriage passes that conservatives start arguing about how government should get out of marriage.yuekit
- no, she is an asshole, clearly. persecuted folks trying to be part of the problem is the argument********
- like i said 2 sides of the same sheeple. you fell alseep in civics class? or your gov forgot to tell you the difference of rights and privilages?yurimon
- We're talking about how the law works in practice. Stop pretending you understand stuff better than everyone else because you read a libertarian blog.yuekit
- This stuff actually does make a difference to people's lives. I doubt you would be so dismissive if some random gov. official started taking away your rights.yuekit
- yukit ked, you are deluded, no one took away the right to marriage, it never existed in the first place********
- Well I guess people have been wasting a lot of money on weddings and divorce lawyers then, you should get the word out to them.yuekit
- in their heart of hearts they already know********
- I never really understood 'rights'. What are rights and why do people think they're owed anything?********
- Really you only have the 'right' to something if you're strong enough or able enough to take it.********
- That said, this dumb fuck needs to hurry up and die...********
- Right are not granted by any authority, they are given to you by birth via the divine creator. states can not grant rights. they can only take them away.yurimon
- The whole point of rights is that you dont have to ask a king or a government to do something. this whole situation is really not progressive to pray to theyurimon
- state for a license...yurimon
- Well I spoke to the divine creator and he said gays should be able to marry...so thereyuekit
- thats cool, if you believe something is a right you dont get permission from the state. its ass backwards thinking.yurimon
- Only problem is that we live in this thing called a society, and the only way to make it work is to have mutually agreed upon rules.yuekit
- But I'm sure it will work great on your anarchocapitalist amish commune, with everyone declaring their own rights.yuekit
- Rights don't exist. It's made up bullshit.********
- yuekit there is a whole history and struggle behind breaking away from tyranny of central institutions, monarchy, church. you name it. for you to make fun ofyurimon
- the billions that died in the struggle so they dont have to ask permission to do something is just ignorant and cold. to turn around and beg the gov foryurimon
- permission is just backwards. its like the dog that is happy when the owner takes out a leash to take him for walk. the leash is your freedom.yurimon
- I'm not making fun of them, just people like you who think you have the answer to everything.yuekit
- Pot calling the kettle black, just a bit.********
- You call it "begging the government". It's not begging, it's the democratic process of changing laws based on an evolving society.iCanHazQBN
- The legal ability to get married is what gays are after... specifically, the full benefits that come with marriage, the ones listed here: http://www.nolo.com/…iCanHazQBN
- Is that clear enough for you? Go ahead and divert the subject like you always do... bullshit semantics on what you believe the word "rights" means....iCanHazQBN
- fixed link: http://www.nolo.com/…iCanHazQBN
- Government is really just a way of people coming to agreement on a common set of principles anyway.yuekit
- Like set said above, you can self-declare all the "rights" you want, but unless other people respect them (or it can be enforced at the point of a gun) it'syuekit
- meaningless. So rights exist in the context of society, not as something you invent on your own.yuekit
- lol, exactly. if you don't want people to divert the subject then don't use words that don't apply. then again your style of arguing is calling people racist a********
- and homophobic if they don't share your world view so it's not a big surprise that your arguments are founded on buzzwords, fallacious logic and fictitious law********
- Oh, please. Everyone knows what's implied by the statement: "Giving gays the right to marry".iCanHazQBN
- The use of the word "right" has been used in this context during this entire (decades-long) fight for gays wanting to get married.iCanHazQBN
- you prob could be more efficient if you had you own shared community, prob cheaper also if you some things were done this way. just fact.yurimon
- this is the grave society has been digging with more and more power integrated into inefficient institutions that take your money, while you get less for it inyurimon
- You knew exactly what we were talking about and what society means by "gays having the right to marry". You were playing bullshit semantics.iCanHazQBN
- if you were a much more better organized community. its backwards bro. its not progress. need a gov stamp of approval how romantic...yurimon
- It's not about romance. It's about the full benefits that come with being married.iCanHazQBN
- We need licenses for all sorts of things, like driving, and owning a business, etc. This is what it's like living in an civilized first world country...iCanHazQBN
- ...There are laws and structure. If you want to live without a government, go move to a tribe in Africa....iCanHazQBN
- ... and then when someone stabs you with an arrow or takes your cattle for no reason, there is zero you can do about it.iCanHazQBN
- wow public school everyone. we bombed iraq for you safety, you want these iraqis having weapons of mass destruction? go live in russia you unpatriotic cunt...yurimon
- while i stand corrected on the legal side of the marriage rights argument, marriage as a civil institution is all the way fucked up. the legal ramifications of********
- marriage can be acted out using various other legal contracts. gay marriage is a token issue, and a hollow victory for civil rights********
- And sorry for calling you a stupid fuck icanhaz, you have questionable argument tactics but that wasn't right of me to rip you down********
