The contextual menu for right-click is, well, contextual. So, the contents are different each time you right-click. For example, when you right click with the Brush tool selected, you get brush options, which is different from what you get when you use the the arrow selection tool which, brings up the layers.
If you're already using the black arrow and you're not getting layers on right-click, then you have a legit problem.
