by this definition, ksm is declared an unlawful combatant. also "the laws of war", as defined by the geneva convention and the rule of law for courts such as the hague, is different than an act of war, as declared by the united states congress. the former, a framework with which to legislate international matters concerning conflict between nations, the latter being a largely formalized national declaration.
