It is an usability flaw. If we were to look for the reason for it I'd say it is a marketing decision, a part of the iPod/iPhone differentiation strategy. It is a tiny pain in the ass detail that pushes people towards getting an iPhone. Just as the scratch-loving iPod back is.
Aren't there remotes for the Touch?
