  I wouldnt go in so heavy handed intially. court action is ALWAYS a last resort.

  tell him that you knwo he is using it and that he hasnt paid for it. And ask him what he intends to do about the situation. Make points about him not paying, and that he is currently infringing copyright, etc.

  And go to bed with a lawyer this weekend who can send a follow up letter on legal letterhead.

  And take drugs too
