    Enough arguing

Let us get to back to our apple and worship it.

    @ernexbcn
Multi-touch was a patent they absorbed and the work there already could understand all 10 fingers at once. Unibody is known as CNC machining and used in the air/auto industry as well as others. They innovated processing the bodies fast enough for large-scale consumer manufacturing, as it is an involved process.

When you read my posts, I never take away from Apple for their packaging, marketing, refining. Their innovation of HOW to bring existing things to market. My core argument is when they make false claims as to what they feel they have created. I won't repeat examples again as my posts are too long already.

As a side note, unibody/CNC is a VERY wasteful process, carving out a solid block of material. You can smelt the remains, but with aluminum, it becomes a poorer grade of material. Odd for a company who claims to be so green. The air industry only does it as casting makes for weaker parts. Sony made a unibody case by casting the block before machining, rather than using raw material. Still strong enough, and better environmentally.

If anyone knows if Apple came up with a good plan for those scraps, I would love to know. I hope (assume) they did.

@ETM I think the ones creating "little overall new" are the rest of manufacturers, and I'm including PC manufacturers here.

Apple must be doing something right when even MS is starting to release hardware (Surface) and pissing off its OEMs due to it. Just Google what the CEO of Acer is saying lately. Google is also starting to take control of the hardware side. Suddenly developing just the software isn't enough, they are following Apple's steps.

People tend to forget how big was the iPhone disruption, like I said in my previous post the best thing that came out of it was that a company had the balls to release the device they wanted without the phone companies having a say on it. Google couldn't even do it with Android and that's why there are so many Android devices that get abandoned on old versions because the ones controlling the updates are the phone companies.

    • Valid points, that i don;t directly argue. But to be fair Android and MS are making some innovations.ETM
    • Android 4.x is great. Win phone tries somethings new. As innovative as Apple, hells no!ETM
    • But unfair to say no one is being innovative. But yes, they ARE riding the current wave set by Apple.ETM
    • Let's also remember Apple only got their carrier deal because AT&T was in the shits at the time. Good deal for AT&T in the end.ETM
    • the end though. Brought them back to life.ETM

Multi-touch wasn't even properly implemented on other devices like the original 2007 iPhone did it until recently. Just by watching YouTube videos of some phones you can tell how bad they are recognising touch or gestures.

    • A great example of refinement. They refine better than anyone.ETM

Anyway, good debate. I don't think any of us are making any new points at this stage. Let's await the trolls and fanboys come Monday morning. :D

so was it the release of the galaxy that they were sued for? the bigger screen? I know 5 people that got the galaxy and i was going to get it but ... then heard the iphone 5 was coming out. I'm also month to month with at&t

With all of the media focus on the U.S. trial of Apple vs. Samsung, it's easy to lose track of the other cases going on around the world between the two juggernauts. The South Korean case just wrapped up and the court ruled that Samsung did not "slavishly copy" Apple's designs. Both sides were found to be infringing upon each other's patents though. Here's a breakdown of the results:

    Samsung’s products infringed Apple’s ‘bounce-back’ patent -
Samsung's Galaxy S, Galaxy S II, Galaxy Nexus, Galaxy Tab and the Galaxy Tab 10.1 have been banned from South Korea.
Samsung will have to pay 25 Million won in damages (which amounts to about $22,000 Dollars.)
Apple's products infringed two of Samsung's patents related to wireless transmission of data -
Apple's iPhone 4 and iPad 2 have been banned from South Korea
Apple will have to pay 40 Million won in damages (which amounts to about $35,000 dollars.)
As far as Apple's "trade dress" arguments are concerned, (that's the accusation of copying), here was the South Korean judge's statement,

There are lots of external design similarities between the iPhone and Galaxy S, such as rounded corners and large screens ... but these similarities had been documented in previous products,” a judge at the Seoul Central District Court said on Friday.
The court also stated that there was "no possibility" of confusion between Apple and Samsung products for consumers.

Obviously, both parties are likely to appeal these decisions, but at least we are seeing some progress. The case was mostly a "wash" for both parties. Now, if we could just get the U.S. judge and jury to pay attention to the South Korean case, maybe some fair and equitable result can be attained in the U.S. as well.

Kind of crazy to see how another jury in another country reacts. Less monetary rewards but banning of the products. Seems like a loss for the south koreans who want to own a product, and likely will just create a black market for the product. Like banning alcohol

The stuff that was patented probably shouldn't have been granted patents. Copycatting is a good thing for consumers. Might hurt the originators of truly original things, but for the most part it allows for other companies to produce similiar items and drive down prices while forcing the necessity for new innovations. Pretty hard to innovate with no start up capital and one player who can just buyout any competition and shelve it. Same shit people worried about with microsoft.

    • only design patent i think samsung could really infringe is if they put a apple logo on their products. other than that all design has been donedeathboy
    • all design has been done beforedeathboy
  • monolith0

this thing is a fucking farce that. The jury foreman basically gave everything to Apple because he wanted to protect his own patents and the other jury members were complete idiots and listened to his "expertise" and voted how he told them. That's why it's so one sided and the verdict that came out so fast that almost every single lawyer says it's idiotic and something very very wrong.

I'll be shocked if this verdict stays on appeal and this whole thing is thrown out as a mistrial..

is it true Samsung paid with 5 cent coins???????

    that CAN'T be true...

    • The verdict just happened. Not even an appeal yet. Why would they pay yet in any fashion?ETM

Things are popping up all over the place. This whole verdict will get thrown out almost certainly.

Steve Jobs response about the party for DiamondTouch technology he basically ripped for iPhone:
"The Wired Magazine reception is not only a great party, but also a showcase for new and entertaining technology. This year there was a live demo of Mitsutishi Research Labs "DiamondTouch" technology. Simply put, a multi-user touch pad or screen that let's a group of people control an application. In this case, we were playing wonderful new computer games.

Here's more information about the technology from the Mitsubishi web site. The video is worth a 1000 words.

    -Steve"

from the Mitsubishi engineer and Steve Jobs:

"Mr. Adam Bogue who is a Mitsubishi engineer said he demoed a piece of hardware called Diamond Touch to Apple engineers in 2003 which allowed users to shrink and expand images by grabbing and dragging their virtual corners. In essence, this is pinch-to-zoom as we know it today."

I guess this is what Apple means when they say they invented it. /s

and of course tap the zoom stuff and sliding screens and UI Apple claims they invented.

And all of this was just skipped because it "bogged the jury down" in giving a win to Apple??

    and of course mandatory

The balls to claim you invented something you so blatantly ripped off

    • I had been arguing similar things in the last couple pages. They over-reach their claims of invention.ETM

"This verdict kicks Google’s Android in the teeth. The result will be higher costs for phone manufacturers who use Google Android and some slowdown in the rapid expansion of Android Juggernaut. I estimate that slowing down Android juggernaut is worth $150 billion to $200 billion to Apple over the next 10 years."

I love the lounge chair (computer chair?) lawyers that seem to know better... Everyone is an expert at everything on the internet.

If Samsung wasn't using Android, hardly as many fanboy/hater nerds would give a shit. This is PC vs Mac wank all over again.

    • no.. this is innovation/creativit... that has been present in tech world for decades vs one greedy ass rip-off companymonolith
  • monolith0

^^ stupid ass article. But I read a few from these imbeciles who are happy Apple won and want so bad Android to be destroyed.

Here's a newsflash.. The war is over. Android won. It's at 68% worldwide marketshare right now, Apple's marketshare in China got split and now Lenovo is whooping their ass over there. Samsung is whooping their ass all over the world and in US and tablets are also catching up big time.

Even if the verdict stands as it is, it's meaningless. These are all old news things that Samsung has already redesigned in the latest iterations of phones and Google completely revamped Android to bypass all of these. The only thing this ruling can cause is that more and more Android manufacturers will switch to pure Google experience which is really actually very good.

If I were Apple and these Apple douchebag bloggers, I'd worry more about whether or not Apple will lose the new patent trial against Google where Google has filed for a ban of all iphones, ipads and even macs for infringing 7 non-standards essential patents.

If Apple loses just one, it's buh bye considering 80% of their revenue is from iPhone and iPad.

    • It won't be bye bye. They'll simply pay a royalty per unit sold.ETM
    • Possibly retro-active,ETM

    Android’s Doomsday Scenario

The doomsday scenario goes like this: In September, Apple will ask the court for an injunction, preventing Samsung from selling the infringing devices within the United States.

If Apple successfully bars the phones at the heart of the case from the U.S. market, the result will be a gaping hole on store shelves. While the ruling doesn’t include Samsung’s latest flagship phone, the Galaxy S III, an injunction would likely force Samsung to concede market share or spend heavily to aggressively develop new, non-infringing models to fill the gap.

Apple then marches through the ranks of other Android phone manufacturers, filing similar suits, winning fines and royalty payments, and possibly injunctions as well. Consumers are left wondering whether or not the phone they preordered will be barred from shipment before launch date - an unlikely scenario, but one that would undermine consumer confidence in Android.
