Frustrating contract issues

I "sweet talked" them. Gave them my points on the reasons for the clauses (strongly), but letting them have the floor as well. I chose not to create too much "noise" on not showing my work for them in Annuals, which was kind of a bummer. And yeah... the work may loose its soul because of that, but maybe I should show that work in PDF's to clients? Not sure.
I took a stand on the cancellation clause, payment clause (5% late fee, which is reasonable right?... fuck, should be higher) which I think they knew was in my right in the first place... they fought a little but as soon as I gave them A financial scenario (a for example, that showed a bit of humanness, they said "ok, it makes sense")
I gave them the floor to explain to me their process (of paying freelancers-- but made them understand that it wasn't about them, I just need to cover myself because I have no "legal department.")
Thanks for your thoughts guys, certainly brought your points into the room.
long live qbn, ha!

I got screwed. I kind of knew it would happen.
She wants my PSD for all of the hard work and illustrations I've done up to this point.
I don't want to hand them over til I get paid. Wondering if this is OK to do.
It's in the contract that I will get paid every 10th of the month. She wants the PSDs by the 4th.
- lesson learned.ohhhhhsnap
- I believe you own your work until you get paid. I personnally would not hand over that psd until you have money in hand. If you don't get the money first, you'll never see a dime. That's been my experience.Mr_Right

What if you handed over half the stuff till you get paid? or half the stuff for half the money, then the rest at final payment?
Maybe they pulled the "we've got a print deadline" stuff on you, then the "client hasn't paid us yet" line on when they pay you.....
I've learned to live with slightly slower payments, but the likelyhood of not actually getting paid is far worse than a wait....
- the second paragraph. exactly what is happening.ohhhhhsnap

2) they are probably a firm that farms out work to people like yourself but their end client doesnt know that they farm out the work so never want them to find out.
?
- yes... I've been in that situation... sometimes you're not allowed to say who you work for....vaxorcist
- interesting. i am certainly never doing this again... got a dose of integrity.ohhhhhsnap
