I'd definitely complain to Cafe Press (although you probably agreed to let them do anything when you signed up)...
You could sue on copyright infringement, but like them, you don't have a case do you? (logos aren't similar)

Yea, Cafe Press already appologized for not looking into it prior to tanking my store. Like I really care, their t's suck anyway.
I totally agree that there is really no dispute here (in either the copyright or trademark arena)
Just too many damn lawyers in the world today, it makes my hair shirt all scritchy...

I think there is a case here, at least something that's worth a small percentage of your time to talk to a lawyer and see what they actually think is or is not legal.

I have composed a strongarm response, stating my case to their lawyer using all of the legal language several years as a CD in a former life earned me. I knew all those damn meetings would come in handy.
I'm also cc'ing it to my lawyer buddy at DLA Piper Rudnick in DC...jeeze they are now the second largest firm in the states...that'll get their attention...

Consider for one second that the sony project entitled 'superbad' may have been purchased and documented earlier than your project. Perhaps it took seven years to make the hollywood go-rounds before production started.
Just something to consider before you tell them where to go.

+ if I remember correctly, seth rogen wrote that movie when he was in HS. But I doubt they had that logo then.

if they are talking copyright, Sony would have to show that the logo infringes on a logo design they did earlier (not the trademark)... The word 'superbad' isn't protected by copyright law.

All of this is pretty much a moot point...Mr. D is right, in these cases whoever has the most money wins. Assuming this ever became a real thing, they would simply bury you under a mountain of cash.

don't even bother. it's not worth fighting a major film company over a film vs your logo you made for fun or whatever. it's a good story though. Or you could represent yourself and make a hobby out of the lawsuit. That'd be fun. Then make a movie about your useless court battle with an entertainment bohemuth. call it 'super super bad' or something

logos are not even close in any manner, sounds like another big company with to much time on their hands. (looks toward 2A with a grin) unless you can positively prove and have documented your design exsisted in any time frame b4 theirs - then forgot about it. you could though represent yourself and just watse their time and money by going to court and appealing each decision over and over again. costs you nothing but suddenly the high priced lawyer is costing them money
otherwise make a shirt and sell it "Sony & Share"
