invoiced - 3 months ago.
still awaiting payment, he's dodging calls.when can i take down the site and replace with a 'client has not paid' message?
is this legal?

I am in the same situation. I am giving them a week before I quit the wait.....then I am going to replace the current index.htm with a pic of my arse.... or maybe just remove it!

i agree about the diplomatic removal. Maybe change the ftp passwords etc too so you definitley have the control.
And warn them in writing a week beforehand i reckon.

change the password. then warn him. even better, put up a page that says "site temporarily down due to financial difficulties"
that will prompt a response. you'll never work for said client again though.

screw the index, pull the whole site down. and point their domain to some other hosts named servers. that should inconveinence the shit out of the client. then send him a randsome letter

Been here - done this.
We provide 3 written notices and try to get in telephone contact as well. Provide a deadline. If you reach the date with out coming to a conclusion on the non disclosure of funds simply change the passwords on the domain and host then pull the files down.
This is the professional way to do it. We have had to do this before ourselves and more often than not you only have to do it once before they get on track.

Taking the site down wouldn't be very professional. Although it might be legal, I believe it won't help you to get the money from the work you've delivered. I recommend hiring a credit management agency, http://www.intrum.com for example, which will invoice the client and handle the legal stuff for you. Good luck!

DO NOT WARN the client. Just pull the site down. If you warn the guy he will lock you out.

i was in this spot once with a client. the invoice was like 60 days past due. so, i took the site down and posted a page that said "site temporarily down due to lack of payment"
then i sent him a note explaining the situation.
he responded right away. the guy was pissed... but, i eventually got paid.
i don't know the legal side of this issue... but, i know if you walk out of a store with out paying they can take their stuff back.
