    i was in this spot once with a client. the invoice was like 60 days past due. so, i took the site down and posted a page that said "site temporarily down due to lack of payment"

    then i sent him a note explaining the situation.

    he responded right away. the guy was pissed... but, i eventually got paid.

    i don't know the legal side of this issue... but, i know if you walk out of a store with out paying they can take their stuff back.
