what do you mean by having them destroy the the code? if you had them sign a confidentiality agreement or ownership agreement in the beginning, you should be covered.
I doubt they gonna destroy the code from their machine. It's like asking a designer to destroy a potentially good portfolio piece.

Be honest about why you're firing him, otherwise he may never learn from his mistakes. Don't be evasive. People see right through it.
