also check your copy of the lease and make sure that your roomate is indeed allowed to sub-lease, as most nyc apartments dont allow that. the answers will be on your lease and in the links above.

oh ok thanks. I will check the lease I think the lease only had one page and doesn't say anything about subleting. think he wants it to be a hush hush thing.

about 14 years ago i was subleasing a rent stabilized apartment on lafayette between prince and spring. the sub lease was illegal and we were the 4th to 5th set of people renting it. the rent itself was $231.38, it was a small 1 bedroom.. every other apt in the area at the time was easily over $2K a month..
1 day i came home to find a 45 page document from the NYC housing authority fixed on my front door..stating .. dear john and jane doe, you have 1 week to vacate the premises of this apartment or all belongings held inside will be confiscated by the city.. i had 1 week to find an apt in nyc and move.. it was cummish!!
it went on and on.. 45 pages.. yes i could have fought it, but probably only to be in the apt with no lease..
anyways.. if your lease states a sublease is not allowed. i suggest you figure out a way to have the lease broken and revised with your name on it and a new roommate.
read thru your lease and the tenants guide rights to see what is your legal rights and what the landlords legal rights are.

oh wow. Yeah i will bring this up when i talk to him. It's so complicated. I don't want a new lease because i kind of want to move out when my lease is up in Aug. Kind of annoying now thinking about it.

im also confused .. if your roommate is moving out and just 3 days later you have a replacement. why is this any issue, the new roommate pays their share of the rent. done et done. correct?

yeah, i worried that i'd had to pay half his rent since he's going to move mid month. Think will be ok.

He is responsible for March rent. Put into writing that you will give him the 50% back when the new tenant moves in. He doesn't really have a choice. He is breaking a lease and you are trying to accommodate him. Tell him it's either this way or you take him to small claims court for making you break the lease. Also when he leaves, make sure you have in writing that he has opted to sublet his position on the remainder of the lease.

it might say it in your lease, that if you have a security deposit, and the lease is broken, that deposit, is now ownership of the landlord.
lots of times landlords put that in as an extra.

oh really i looked at the lease it's only 1 page and doesn't say anything. Are they usually long? I will check and see. i wonder when we give up the lease, i can have to landlord pay me all the deposit money.
