Are Flickr images legal to use in ads?
I don't get the feeling they are but are there any extenuating circumstances where they can be used? The agency I work for just released a bunch of ads using a Flickr image. The guy who used the image was laid off on Friday, just to add a sick twist to this story.

If you own the picture posted on flickr then yes... but otherwise not a chance in hell unless you want to get sued

it depends. if a photographer shot someone without a model release and put it on flickr with a loose cc license, and you take this photo for an ad, you can be fucked very easily (the photog too, but do you care?). besides you most often than not have to put owner's name on the photo which always looks cheap. best advice: ask the photog and clear the rights, usually they're happy to get more than microstock would bring.

Usually a huge NO.
But ALWAYS contact the photographer in question and tell them up front who your client is. You never know they might do a deal.
