a client has neglected to pay me my full amount. only half so far and said he couldn't pay the rest. offered me a settlement of half of the remainder paid over the course of a full year. obviously i said the full amount or no deal. so now i'm asking for payment before the end of the year or i'll go to the courts. this is for the US btw. has anyone had to go through this process in the US? if so, is it fairly simple (make a claim and show up?) are there any links anyone can offer for me to research?

Small claims court.
This will hurt you in the long run if you have to apply for loan / apartment etc. Most of the time they ask if you have been in a part of a law suit (not sure if small claims count)

Did you consider using a collection agency? Costs a bit, but saves time, legwork and frustration.
- Thats also good in avoiding being part of a law suit.********
- any links to ones you would suggest using?free_

1k is too much for small claims court. are you doing business under and llc or s or c class corp? did you have a nonpayment clause in your contract? did you have a contract? if so this will skirt the lawsuit issue jsk mentioned.
i would talk to a lawyer and have them draft a letter on your behalf threatening legal action unless the payment is received by a certain date. keep in mind suing will cost you legal and court fees so use it as a last resort.

I know this is a completely different issue -but I took a landlord to small claims in college, it wasn't for nearly as much money and it was in OH so it could be completely different. The amount you're looking for is too large for small claims, but if you go into it and have to pay legal/court fees - you can sue for those as well so you don't have to end up paying anything out of pocket

i thought small claims was up to $3K
- not in Ohio it wasn't at leastmegE
- I'm almost sure it's more than 1k in Ohio. Like $2200 or something.404NotFound

most of the time just saying that I'll have my attorney contact them for payment I get the check lickity-split.
