How do you go about applying for or getting clearance on using other artists samples for use on a commercial release?
You know when you hear a dance song thats blatantly ripped a sample loop from one (or maybe more) other big tunes. - Think Thomas Bangalter (daft punk) kind of stuff.
He'd be alright cos he has a record company sorting sample issues out for him on whatever he wants to release. But what does joe bloggs have to do to get clearance to use in a commercial song? Do you have to work out a royalties deal?
Anyone on QBN ever done this or know the process?

personally i don't clear shit. my stuff doesn't sell enough to warrant it. also, if you're just doing a "mixtape" you're usually cool and don't need clearance.

Call their record label.

^^ a lot of times that doesn't work.

also - a lot of people these days just have the sample replayed. there are some really good guys doing that now, ken lewis being one of the best.
replayed samples are all over the newest kanye album. there was an article in remix mag about it a few months back.

It's easier to just make up new stuff. By the time you've gone to all the hassle of clearing a sample, you could have done something new and decent yourself. And it's cheaper, so there's the added bonus of more profit in the end.

Get the publisher info from Harry Fox, BMI or ASCAP, etc. Be prepared to do some detective work. Once you find the publisher, call 'em. That's what I did anyway- trying to clear a Scientist sample from Greensleeves. You gotta be persistent and if you get the green light, well, you gotta pay.
In the end, I did what boobs is suggesting- I hired a singer to come thru and voice the part I was sampling. Came out better than the original!

Cheers for the info.
As it said in one of the links provided, replaying tunes might not give the right groove/tone esp when mixed up with other samples in your song - like youve matched all the instruments in the song to the sample you'd nicked.from following the links and doing a bit of reading i found this

they charge a fixed rate per sample, that seems like a pretty good deal as it appears it can be a long drawn out hassle to get a sample cleared.

stop being such a pussy and start stealing that shit
- 23kon0
Hehe, ive already done the stealing and the song is a work-in-progress
The song has so much potential as a BIG club/anthem song or a song for girls to dance to in their bedrooms to, the hook is f*ckin amazing.
Normally I wouldnt bother with sample clearance, but i'd like to "do this one properly" so that if the song did become big, then id be getting some £ for it and not every penny taken from me!- the main thing is that you've managed to maintain your modestymax_prophet
