Copyright > well, i would say that whatever has been created by an Artist (music photo painting...etc), has a copyright and therefore the Author needs to be informed and at least mentioned in order to put things right from the start. You probably need his/her approval to use it.

Technically, you usually are not allowed (and no - the "30 second rule" doesn't apply) without their (or their rights' holders) permission.
I've found that more "indie" bands/groups are more responsive to this sort of thing if it's in the vein of promotion, but I wouldn't bet on it.
- Also depends on what country you're in and whether or not it falls under "fair use" - but that's a whole other pandora's boxolli101
