Maybe you can help. This is the situation. someone has died, he is the last member of his family and leaves a girlfriend [no more than that] of about 4 years. As far as we know there aren't any distant family members left. What happens to the estate? Does the girlfriend get it or does the court decide?

is that for definite? And would it be up to individuals to prove their non family relationship to the court? I'm sorry this sounds like a plan is hatching, it isn't, there's just a whole load of shit going on with it!

If a person dies intestate, with no identifiable heirs, the estate generally escheats to the government.
So, ummm, the state will get it.
