MySpace Legal Issues

I was doing research on myspace for a project I was working on and I noticed all the free myspace layout pages included categories such as celebrity, NFL, NBA, Nike, Lakai etc....
Isn't there some sort of legal issues with using someones brand. All these sites can't be paying licensing rights.
Anyone have any idea if this is legal or not?

How do you mean exactly?
I can tell you from our companies' meeting with MySpace the branded pages (like for Coke or something), those brands are paying 6 figures to ahve thse.

Do you mean fan sites and people not affiliated with MySpace offering these layouts?

If you go to sites like http://cleanupmyspace.com you'll see they have layouts created for brands like DC, Red Sox, Fox Racing etc...
I know these companies are making money but I doubt any of them are paying for the rights to use these brands and I'm trying to find out if this is the case and what legal issues are involved

i have no idea. But my guess would be - if they are selling the themes, then yes, big problem if they are not paying rights. If a user can download them and use them, then the brands are totally fine with it. That's the entire point of a brand even being on MySpace, to be viral and to get impressions.

I understand that it would be in a brands interest to allow this, but I find it surprising that companies such as Nike or the NFL who usually have very tight controls on what gets put out with their name would allow it.

they arent selling the profile templates they are only prob making money from the advertising on their websites from other companies.
like someone said, it would be in the interest of the NFL etc to allow these as these pages are for FANS of the NFL and arent really for any commercial purpose. if anything its free advertising for the NFL on peoples personal pages, no?
Maybe they might have issues with how their brands are used etc. but essentially these are just pages for fans.

I dont think any brands would start "selling" myspace templates as there are too many free ones out there.
It might be within their interests to create some really amazing ones like on the lovemyflash site. definitely good form of promoting your brand.
