I was given EPS files made in CS2-3, I'm assuming. i can't open in CS1.
any idea on how to convert without downloading the trial CS2, just to covert to an earlier file. I was thinking opening in PS then taking out the background but bit of a pain in the ass.

It sounds odd that you wouldn't be able to an eps in PS. Have you tried Illy?

i can open in PS-CS, I cant open in Illy CS cause, I'm assuming its was made in Illy CS2.

Run it through Distiller to make a PDF and then open the PDF in Illustrator.

thanks adobe, for making it tough, like all those cs2 and cs3 psds i can't animate in AE 6.5 now because maximize compatibility isn't doing it
