do we as designers, by default, own all rights to work we create for clients?
i want to specify in our contracts that we own all rights to work until complete payment by the client, in which case then all right are transfered to the client.
is this legal? should there be formal paperwork involved?

That sounds about right.
But then I always just wing it and keep an air of imminent violence about the place to make sure I get paid.

you own your work until you sell it. If you are engaged in wor-for-hire, ultimately they own it. other deals function in other ways.
Absolutely use a contract, that specifices ownership and its parameters. at all times.
