Image Copyright?

Anyone know the legal matters of image copyright? For example, if I draw a picture of David Bowie as Ziggy Stardust, while looking at a photograph, and then try and sell it, is this copyright infringement?

Then why is it that portrait artists at a common mall do not get sued for selling images like this?
You know, the little booths where people draw your picture, but also sell images of movie stars...

You can get away with it until you get a 'cease and desist'. Some cases which found in favour of the artist:

Interesting reading. So if I understand correctly, if the work looks drastically different from the original (work), it is ok in that it is a work of artistic expression rather than a (copy)?

but also depends what it is of (permissions you have, original artists rights assertions), and what you are going to do with it.... its complicated.

if it is recognizeably the artist, and they find out, you could be in some trouble if youre making some cash from images you are making that are basically of them.
if it's more about something else less about the famous person youre depicting, then that seems fine.
i see this shit near canal street all the time here in manhattan, always kinds of pisses me off because everyone thinks they can make a buck off of someone elses image.

If you are just talking about drawing some famous schmuck and selling the work, then my advice would be to just do what you want.
if someone finds out and you get reported, the worse that can happen is a cease and desist order.
It's not as if, 1, you'll make millions and 2, you'll stop them making millions.
