I began a project back in Nov. which was to conclude appx. mid Dec. The project was in 2 phases. The fee schedule was set up for three payments. 1/3 to start, 1/3 at end of phase 1, and 1/3 at end of phase 2. Midway through ph2 they hire a new project manager who decides to put the project on hold while he rethinks their strategy. FINALCHECKUS INTERRUPTUS! Met with them yesterday and they're all ready to continue ph2, but with modifications to the original plan. WTF?
This is 20 days beyond the planned completion date with no loot from them until and of Jan. I think I should negotiate a new contract but (obviously) I am unsure.
Thoughts?

I don't even understand how you can be hesistant to negotiate your contract here.
It was based on a timetable that has changed. Just do it.

the industry term you're referring to is called, "scope creep" and for that you should tell you're client you will be happy to do a "change order" for them.

DEFINITELY new contract. NO QUESTION. I've run into this before. It is outside the scope of the original contract so you must write up a new one with different (additional) monies as they are asking you to do more now.

If you negotiate a fixed price for something, always set an hourly rate as well in the contract for any additional time, and for situations like these.

scope creep isn't really a term you might say to a client but it's basically what clients tend to do, try and squeeze in work outside of the statment of work (SOW). and feel free to use acronyms like that infront of the client, so things sound more legal.
