Apologies for a long post:
I've got a client who is putting out a monthly publication, mainly of ads geared toward a specific demographic. If companies want to advertise but don't have an ad ready, they can pay a flat fee for me to do one.
I just read this article to clarify the whole work-for-hire deal

My concern is if the company wants their ad, how do you feel I should handle this? They are not my "client" but I don't want to put my client in an uncomfortable position. I'm thinking of putting a statement on the sign-off proof that says if they would like to "own" the ad, they pay a flat fee (mainly because the flat fee they originally paid is pretty cheap). Do you think the "statement" i put on the sign-off sheet will scare away or cause bad feelings for my client? should i just let it go, bend over and give them the ad (but not the stock photos used)?

what are the policies of the publication? there should be a contract for the placed Ad as well

the more official the legal document, the more respect you'll get from professional clients. they want to believe you're legitimate and doing things by the book.

There is no official policy yet for the publication. It's brand new (first issue is Jan '07). I'm doing the layout and any ads that need to be done. I'm thinking that the policy will fall to me to create so I want to make sure that neither I nor my client will get jacked in the scary alleyways of Reno.

Make them sign a clause that says you're not responsible if the creme burns.

the other side of the business is a lifestyle mag for our area
small, completely ad driven
sounds similar, you should email me this week with questions and i'll ask the other side of the room how they handle it
