How do you deal with a lead that wants you to design first and if they like they buy?
Why do they think that they can get away with this?

its called a rip off. the answer is no. If your portfolio is not a good enough example of your work, they need to move on. If anything, they need to sign a contract with a kill fee. Now, I have done that.
Some agencies event do kill fees when they do proposals with comps included. But, you still get paid for your initial time. If they like it, it's taken into consideration that those ideas were rough and you begin going into rounds of addtions and revisions, or possibly everyone missed the mark and they ended up going with you because they like yours the best -- In which case you comp all over again, but with the contract awarded to you.
Moral of the story? Contract or no deal. Else you'll be one of those "I got fucked" stories that gets posted on Newstoday weekly (daily).

It's just like a regular contract with your prices. If they pull out after the initial round its ____ amount. after second or third design round its _____ amount. After design is completed and signed off on they're obligated to pay the balance after production and programming as been completed. done done done. you would add a similar chunk of text where you would usually put your phase descriptions and pricing break downs. As always, you include how many rounds of design are included, how many revisions are accepted. My favorite line being "After each round, all revisions must be consolidated in one all encompassing request." so you dont get a bunch of changes one day and a bunch the next, and then one or two more later and have them call that "One Round".
I work at an agency I can't give you an example of our contracts. Sorry bud.

Tell them what they are asking for is unethical. Then ask them when they go to the supermarket if they eat the food first to see if they like it before they pay. Then send them to this site...

This is what happened:
I got a call from the marketing manager who got my name from a client. During the meeting I showed them samples of prints and ask them series of questions on what it is that they would need my service for.
They were looking for brochures, flyers, bc, postcards, and presentatons folders to be design. I then mentioned that I can design these no problem and that since I print what I design you won't have the hassle of dealing with a printer.
I then told them how many are you looking for (brochures) He said, and this made me laugh inside, "I don't know, it depends on how good your design is." I will need to see a sample. Here is the cd with the images that I want to use." I kept on saying that I will need to go back to the office and give you an estimate, from there , if the price is a go - then I will start to work on the project with 50%.
I don't think that he understands that a professional will not "design" first and if you like you buy.

i deal with this all the time. I have done templates that were on the money as far as what was discussed only to have client point to site made in 97 or something saying "do it more like this".
and the iFrame lives on.
