so what happens if you make a logo that is exactly the same but by accident. can you still be sued? just redo it? how do you prove you didn't rip it?

even accidental i don't think there's anything to prove. who comes first takes the lot.

It seems almost impossible not to repeat a shape without some extensive trademark search that probably only large companies can afford. Especially since logo designs have gotten simpler over time.

we did a logo in my studio and it went really far until the client found that another company had the same logo (and sold the same type of product) so we had to drop it, their lawyers were having none of it.
It shouldn't be that hard to come up with a new idea.
Plus the renault/quorporation logo is such a simple geometric shape I'm sure it's been done loads of times as the whole quark logo thing proved

this happens more and more – especially with simple geometric shapes as someone mentioned
this bit me in the ass a few months back, but the conflict was with a company from a different industry in a different part of the country, so we're coexisting from a distance with very similar identities
but it ruined the whole project for me, dammit

the burger king one and media kitchen comparison is the funniest shit anyone ever pointed out. i think even if the did "rip" off burger king..they still used the concept wonderfully. the client is media kitchen, oh ok, lets throw some hamburger buns around some sweet ass text. seems fine to me.
