Personally I would not piss off, or get the publisher involved, you may need them/them need you in the future.
IF this does not work out for you, learn from it, and never never never give over your work before they give over the money!! We are protected by copyright law, especially if you freelanced the job, and it was not through the publisher. The work that you did is automatically copyrighted upon completion.
Also IF he gets away with this, think about it, he will prob not only have lack of respect for designers, but he, and his friends, will do this again and agian until they reach my front door....so....sue the shit out of him!

I think you said it best. I can't get the publisher involved and that would only hurt me. I know alot about copyright laws and the client actually did use photos without a license so my next move is probably to sue for infringement which would be a much steeper penalty than the $1000 that he owes. In fact the work appeared in the NY Times so I may be able to get a lot for it. HOWEVER, the catch is this: Do I have an infringement case if I was the one who submitted the work to the NY Times? Can I sue for infringement simply because I havent been paid for the job? Probably not, huh?

i think it's about time you asked a lawyer. although the $1000 may not be worth it, teaching that ass a lesson might be.
I work for a web development firm, so when clients don't pay for a few months, we turn off their site. then they either slink off into the dark, or overnight a check to us.

yep, the web biz is a great one to be in cause you can dangle that site over their heads if they dont pay up. Unfortunately this particular gig was print and photo so I dont have shit... except the copyrights... grrr
