i found a song i'd like to use in a flash presentation. i'm assuming that it would be big bucks to pay the artist to use their song.
does anyone have any resources on how I would go about checking into this?
or, if it turns out to be big bucks (and I'm sure it will) are there other companies you could suggest who could create a tune very similar to what I want to use.
Hope this makes sense. It's early.
thanks,

you can use it for persoanl use without question.
you cannot use it or resell it for profit.
sampling laws allow to use 5-7 seconds without infringement i believe check ascap for details

This is a Flash email being sent out to potential new business prospects. So we're not profiting from it, yet. :-)
But I assume there is some kind of usage fee. I'll check the ascap.com site.

you can not distribute. the best bet would be to host it somewhere and send out links to the work instead of actually emailing the file to each individual. that retains the personal use

"There is also a rumor going around that you can use four notes of any song under the "fair use" doctrine. There is no "four note" rule in the copyright law. One note from a sound recording is a copyright violation. Saturday Night Live was sued for using the jingle, "I Love New York" which is only four notes. The test for infringement is whether the sample is "substantially similar" to the original."
