A Florida restaurant claimed they were afraid pregnant waitresses would drop heavy trays of food harming themselves or their unborn children, so they developed a policy that required waitresses to assume subordinate jobs as cashiers or hostesses after their fifth month of pregnancy. Three employees sued for violation of the Pregnancy Discrimination Act. The court found that the policy set an arbitrary date for reassignment that treated pregnant workers differently than non-pregnant workers and ordered the company to pay $300,000 in punitive damages.
