background checks

    My brother is on probation as he was arrested when he "best friend" set him up and got him on a wire for getting him a sack.

    So it was a felony dropped down to a misdemeanor. The main problem is he hasn't been able to get even a crummy job to due background checks for the last year. He finally got a job at a well known department store (starts with a K), went through the orientation, etc. Came to work Monday only to be told we checked your BG , you're a dealer, you're fired.

    Anyone have similar stories, advice, work options, know of the legalities of getting hired and fired for that immediatly, etc?

    BTW: not to go off topic but this 'best friend' thinks he a ganster hip hop thug and setup two of his best friends to avoid a few weeks in an easy going jail for a string of really dumb crimes and mistakes of his own doing. He cost my family thousands in the process.

    Not to make excuses though because my brother technically shouldn't have done anything illegal anyway.

    My advice would be to be honest. He should tell them about his past. If they don't hire him because of that, they don't. At least it saves him the humiliation of being fired after a couple of days.

    That or move to Canada. They can't do BG checks in another country now can they?

    I dont know what exactly he put down. He said he was honest and put that he had been arrested before and was still hired. It's only a misdemeanor but because it's related to drugs I guess employers will refuse to hire him.

    I've heard BG checks only go back 7 years or so. So I told him to concentrate on school for now (he's 20 and wants to be a psychiatrist) but he cant even seem to get a crappy job just to get by at all.

    Thats it? Im sure some of you have less than perfect records. I was hoping for more of a response.
