I have been doing business as Screaming Cactus Design for about 4 years now.

To my surprise I just found
http://www.screamingcactus.netThey just bought the domain in January and I track them daily visiting my site (no big deal there)
My question:
Is there anything one can do stop the name rip?
Why would a creative design company cmpletely rip a name from an existing firm? I think the name is unique enough to not be a coinscience.Any thoughts or experiences?

theirs look pretty shite IMO, so I wouldn't worry about stealing your clients, but if you trademarked the name they're going DOWN!

1) trademark the name like any self respecting company
2) buy .com, .net, .org, and .weiner of that name to make sure no a-hole can 'take' your name.
3) there's nothing you can do. sorry.

I don't think there's much you can do unless you can show people could confuse them for your thing. you need to show you lost or could lose clients because of the similarity in names.

i'd put a bit of text on your site about the name rippers, saying how lame they are. if they're checking it everyday they'll see it.

if you trade mark your name i think all you have to prove is prior use, and contact a lawyer to send them a cease and decist (sp?) letter. that should scare the bejesus out of them,.
unless of course they are in korea, or some other country, in which case they will most likely laugh at you and go have some shrimp dumplings.

Considering they are half-way around the world from you... I wouldn't see the problem.
You guys should join forces, as the Northern & Southern Hemisphere branches. Just a thought.
