two months ago i started a freelance project to design 4 high res images for a brochure.
the images were to be supplied by the client.
i was to take these bought images and incorporate them with 3D models supplied by the client to mock these images.
the client only sent me two images (cause they were more expensive than they thought, and because of an insane deadline imposed by the client)
i have 20+ emails stating things like "this email is giving you the ok to proceed" and "drop the bike, train, and inhaler images and go with the plane and needle."
so now it's been three weeks since i've finished and he said the check was in the mail and no check. i sent him a nice email FYI no check and he sends one back saying the images aren't done. my roommate works for them and has told me the brochure has been printed and used already for a show so the brochure is in fact done.
this client hasn't contacted me once to 'finish' the images and has made no attempt at finishing the work.
i have no contract but i do have a proposal and have saved all his emails. i didn't use a contract because me roommate is working for the company and said he was a nice guy. it was a simple job to do so i didn't think i needed one. i know i'm a fuck but what can i do?
i've got like 30hours in the project and i sent him back another email 30 minutes ago explaining that he has made no effort to 'finish' the project, and i have 30 hours invested along with all of his emails and blah blah blah with no response from him.
leagally what can i do if anything?
could i scare him with the thought of an attourney? any ideas?

what sucks is that the client is always right. Drudge through it and take their money

well my biggest issue is that he says the work is unfinished yet he went out and printed the brochure and is using it at tradeshows.
i'm afraid the work will never be completed cause he's using what he's got now ya know.
i'm thinking a couple bricks through the window might get the ball rolling in the right direction.

Surely if he didn't pay you for the images, then he has no legal rights to use the work you produced?
That'd be your main way of collaring him in my book. Or just take a lump hammer to his scrotum.

Kona, send him an email or letter stating that you are aware that they used your unfinished work and you would like to rectify the situation ASAP. Tell him that his statements that the check is in the mail has been deemed bullshit and that if he continues to fuck with your money, he's going to get his ass beat by a ghetto ass designer.

Have you seen Fight Club, go in to his office Shit on his desk and start acting like a nutcase - He'll soon pay up.
If not get in touch with a brief, if you have all the emails you should be good to go, after you get your $$ sign the fucker up for every spam list going ;-)
