lawyers are a last resort IMHO. Pulling a website down because it hasn't been paid for is a first step. just be diplomatic about it. sound compassionate... like your average landlord who talks his way out of fixing your floor or something...

loopyd is right, I was in the same boat about 2 months ago. I got a lawyer to write a "Payment Demand" letter, and it resolved my situation. Most firms are not going to fight with a lawyer, for less than 2 grand.
My advice is to talk to a lawyer, just my 2 cents...

a "Payment Demand" letter? that actually sounds reasonable. and it would prolly scare any client into paying if it comes on lawyer letterhead. good point.

not trying to be an ass, but a "Payment Demand" letter sounds kinda like an invoice to me. Isn't the nonpayment of an invoice the problem here?
Or is the letter actaully something like pay me or I'll seek legal action?

and then in that instance, my questions is:
Do you warn them of legal action so they can prepare for it, or do you just have a lawyer send the letter, so they know legal action is already in the process?

my impression was that a payment demand letter comes directly from the lawyer. ha, yeah otherwise it would be an invoice... lol. fuck all that just pull the damn site down till they pay.

What I did was sent them a email and copied myself, my lawyer, Head of Accounting, and the owner of the company saying pay me by x date or my lawyer will be handling this from now on. The she sent a letter from her office saying pay me or legal action will be pursued...
Worked like a charm. Hope it helps...

i got the check today. i guess everything worked out ok. he did end up changing the ftp access for his site. i was getting a little worried i would never see a check.

I tell you what is wrong...the website.
Oh my god! You would have to be a complete tw*t to hire that shit company to do anything for you. Im sorry, but sometimes I just dispair at some of these crap little talentless agencies. Have a look at the text in the creative section. Here are a few good lines;"Pimento has put together an incredible roster of creative talent"
"Our staff is proficient in ..."
"We look forward to visiting with you..."
This is perhaps the crapest website I have ever seen!!!
I really hope jpowell never works with anyone like this again because whoever runs this company is cleary a con artist.
I am right about this? What do you think?

olybobs is right the guy is a con artist. i don't see his "business" working too much longer. everyone in the kansas city area already sees him as a scam. the AIGA members and other creative clubs know him as a shady deal. he just recruited me to work for him so hardcore. i won't ever work for him again. it has taught me many lessons.
