it depends on how prominent the person is present in a picture. then there's also the issue of taking a news-photo or not. Then in some cases people agree to be in the picture on the spot, without release form. I have seen it all, i have lived all my life in photography and film.
There's so much to it to make a proper judgement.
but hey, it may be different in the US though, seems like people are a lot more uptight about it over there.
