Careful with that code A List Apart nosense. I had some major issues with it before I ultimately abandoned...

First off, if you use transparent backgrounds in Flash they won't work at all on some browsers.

Second, loadbars tend to get very, very screwy. Preloading MovieClips is already a little wonky (you generally have to wait until at least a few bytes are loaded before you can execute code), so doing that with a banner or a a complte Flash site could be bad news.

And realistically why should it take 2 files to load one SWF? Don't you think thats a little assinine, especially when you consider that its ultimately not saving you any code?

The W3C and Macromedia don't seem to be seeing eye to eye quite yet here. The EMBED tag will ultimately go, but the object tag on its own is a less than stellar alternative.

Unless your site needs to work for XHTML Strict (in which case my next question would be why?), I don't think any client will destroy you for abandoning standards here.

Not any client that wants Flash on their site anyway.
