a secondary color would be nice. #1 is good, albeit typical. not a fan of the hard nav bar, incorp. into the flash header maybe, bring the blue bg down and place the menu in there.
the bird is flying the worng way on the logo and in the flash but I'm guessing that's them and not you.
the photo is a good one.
