The battery monitor works by watching the voltage decline as the battery empties, if it's being innacurate it's probably an issue with the battery not the ipod. This is comon with new batteries, or batteries that have been improperly charged. Just use it until the battery is dead, then charge the battery all the way up, and make sure to always charge from dead or very near dead untill full, that should fix your problem.
