Go with the 40.
Back in the day, when mp3 players first (and I do mean FIRST) came out, I bought a 64MB mp3 player. There was a 96MB option, but I thought, "I'm never going to need that much." Invest in the 40. If you're at 30 right now, and most of it sucks, the 40 will last you awhile. I do agree with the earlier statement of buying better headphones, though. The standard ones aren't so great.
